These Terms of Service (“Terms”) govern your access to and use of the ArcadeOn Studios website at arcadeonstudios.co.uk (the “Site”). We refer to ArcadeOn Studios as “we”, “us” or “our”. By using the Site you agree to these Terms. If you do not agree, you must not use the Site.

1. Acceptance of Terms

By accessing or using the Site, you confirm that you are at least 13 years old (and at least 16 in the UK and EEA for the purposes of providing consent under data-protection law), and that you agree to be bound by these Terms and our Privacy Policy. If you are using the Site on behalf of an organisation, you confirm that you have authority to bind that organisation to these Terms.

2. Who we are

ArcadeOn Studios is an independent studio based in the United Kingdom that builds games and software. This Site is our informational home on the web: it tells you about who we are and the products we make and publish. Individual products are governed by their own terms and licence notices, which we make clear at the point of use.

3. Accounts

The Site does not offer public self-registration; browsing our pages does not require an account. We do maintain a small number of internal accounts for our own staff and administrators. If you hold one of these accounts, you agree to:

  • Provide accurate, current and complete information;
  • Keep your password confidential and rotate it if you suspect it has been compromised;
  • Be responsible for all activity carried out under your account;
  • Promptly notify us at hello@arcadeonstudios.co.uk of any suspected unauthorised use.

4. Acceptable use

When using the Site you agree not to:

  • Break any applicable law or infringe any third-party rights, including intellectual-property rights;
  • Impersonate another person or entity, or misrepresent your affiliation with anyone;
  • Hack, reverse engineer, probe, scrape at scale, or circumvent any security feature of the Site;
  • Upload or distribute malicious code, spam, or content designed to cause harm;
  • Harass, threaten or harm our staff or other visitors;
  • Use the Site for any form of real-money gambling or wagering.

5. Intellectual property

The Site — including its underlying software, our designs, logos, text, graphics and trade marks — is owned by ArcadeOn Studios or its licensors, and is protected under United Kingdom and international intellectual-property laws. Nothing in these Terms transfers any of our intellectual property to you. You may not copy, modify, distribute, publish, reverse engineer, or create derivative works from the Site except where expressly permitted by law or by us in writing.

6. Third-party links & products

We build and publish games and software, and this Site may link out to those products and to third-party stores, platforms or websites where they are hosted. Those destinations are operated by us or by others under their own terms and privacy notices, and using them is subject to those terms rather than these. Links to third-party sites are provided for convenience only; we do not control and are not responsible for the content, availability or practices of any third-party site.

7. Account suspension & termination

We may suspend or terminate access to any part of the Site, or to an internal account, where you breach these Terms, where we are required to by law, or where continued access poses a serious security or reputational risk. Where the breach is minor and capable of cure, we will normally give you a chance to fix it before suspending access.

8. Disclaimers & limitation of liability

The Site is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, whether express or implied, including implied warranties of satisfactory quality, fitness for a particular purpose and non-infringement. Information on the Site is provided for general information only and may change without notice.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under English law — including your statutory rights as a consumer.

Subject to the paragraph above, our total liability to you arising out of or in connection with the Site in any 12-month period will not exceed £100 (one hundred pounds sterling). We will not be liable for any indirect, special or consequential loss, including loss of profits, revenue, data, content or goodwill.

9. Governing law & jurisdiction

These Terms, and any dispute or claim arising out of or in connection with them, are governed by the laws of England and Wales. You and ArcadeOn Studios agree to submit to the exclusive jurisdiction of the courts of England and Wales, without prejudice to any statutory rights you may have as a consumer under the laws of your home country.

10. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date at the top of this page will reflect the most recent version. Material changes will be signposted on the Site where appropriate. Your continued use of the Site after changes take effect constitutes acceptance of the updated Terms.
